This Notice explains how we obtain, use and disclose your personal information, in accordance with the requirements of the Protection of Personal Information Act (“POPIA”).

At Cape Cookies (and including this website), we are committed to protecting your privacy and to ensuring that your personal information is collected and used properly, lawfully and transparently.

About the Company

Cape Cookies (Pty) Ltd – manufacturers of baked cookies, rusks and snacks.

The information we collect – This is known as “General Personal Information”

We collect and process your personal information mainly to contact you for the purposes of marketing our products and Independent Agent business, and delivering services accordingly.  For this purpose we will collect contact details including your name and organisation.

In our Independent Agent business, we collect information directly from you where you provide us with your personal details.

How we use your information

We will use your personal information only for the purposes for which it was collected and agreed with you.  In addition, where necessary, your information may be retained for legal or research purposes.

In our Independent Agent Business, we disclose your personal information to our service providers who are involved in the delivery of products or services to you. We have agreements in place to ensure that they comply with the privacy requirements as required by the Protection of Personal Information Act.

Information we do NOT collect

We do not collect “Special Personal Information”.  This refers to information about your race, ethnic origin, trade union membership, political persuasion, health or sex life, criminal behaviour or biometric (fingerprint) information.

We also do not collect “Children’s Personal Information”.

We are legally obliged to provide adequate protection for the personal information we hold and to stop unauthorized access and use of personal information. We will, on an on-going basis, continue to review our security controls and related processes to ensure that your personal information remains secure.

 Your Rights: Access to information

You have the right to request a copy of the personal information we hold about you. To do this, simply contact us at the numbers/addresses as provided on our website and specify what information you require.  We will need a copy of your ID document to confirm your identity before providing you with this personal information.

Please note that any such access request may be subject to a payment of a legally allowable fee.

Correction of your information

You have the right to ask us to update, correct or delete your personal information. We will require a copy of your ID document to confirm your identity before making changes to personal information we may hold about you. We would appreciate it if you would keep your personal information accurate.

Definition of personal information

According to the Act ‘‘personal information’’ means information relating to an identifiable, living, natural person, and where it is applicable, an identifiable, existing juristic person.  Further to the POPI Act, Cape Cookies (Pty) Ltd also includes the following items as personal information:

Selling your data to third parties

We DO NOT sell, rent, or otherwise disclose personal information collected by Cape Cookies in the ordinary course of business to any third parties or agencies for marketing or advertising purposes.

Use of “Cookies”

We do not use Cookies to identify your browsing patterns.  We may, however, use your order history to determine which Cookies you enjoy in order to improve our promotions or special offers.

Electronic Communications and Transactions Act

We also voluntarily subscribe to the principles, outlined in Section 51 of the Electronic Communications and Transactions Act 2002 (‘ECT Act’), which govern your right to having your personal information kept private. We briefly outline these principles below:

We will only collect, collate, process and store (‘use’) your personal information with your permission as set out in this Privacy Policy, unless legally required to do so, and will only use such information for the lawful purpose for which it is required as set out in this Privacy Policy.

We will not use your personal information for any purpose, other than that which we disclosed to you herein, unless you give us your express written permission to do so, or unless we are permitted/required to do so by law.

Further to the requirements of the ECT Act; we will disclose your personal information without your consent:

In terms of the Consumer Protection Act and section 45 of the ECT Act, you understand that you have the option to opt out of any mailing list maintained by Cape Cookies for commercial and marketing communications (see the next paragraph for more information on how to opt out).

Changes to this Privacy Policy

We reserve the right, in our sole discretion to update, modify or amend (including without limitation, by the addition of new terms and conditions) this Privacy Policy from time to time with or without notice. You therefore agree to review the Privacy Policy whenever you visit the Cape Cookies Website for any such change. Save as expressly provided to the contrary in this Privacy Policy, the amended version of the Privacy Policy shall supersede and replace all previous versions thereof.
